By placing an order or completing payment, the customer agrees to these Terms & Conditions.
Nothing in these Terms & Conditions affects any statutory consumer rights that cannot legally be excluded or restricted.
1. About PremiumSalezUk
PremiumSalezUk sells pre-owned and, where expressly stated, refurbished smartphones and related devices.
Unless specifically described otherwise, devices are second-hand and may show reasonable signs of previous use.
The individual listing explains the checks performed and their results.
2. Product descriptions
PremiumSalezUk aims to describe every device accurately.
Depending on the sale, the product description, invoice, payment request or customer messages may identify:
- Device model
- Storage capacity
- Colour
- Battery health
- Cosmetic condition
- IMEI or serial number
- Accessories included
- Known faults
- Known repair history
- Known replacement parts
The device-specific information provided before purchase forms part of the contract.
UK consumer law requires goods sold by a trader to be as described, of satisfactory quality and fit for purpose.
3. Used-device condition
Customers acknowledge that pre-owned devices may contain reasonable cosmetic wear consistent with their stated condition, age and price.
Examples may include minor marks, light scratches or signs of previous use where these are consistent with the description given.
Known material defects will be disclosed where known to PremiumSalezUk before purchase.
4. Battery health
Batteries are consumable components that naturally deteriorate over time.
Where a battery-health percentage is stated, it reflects the reading available at the time the device was inspected.
Battery health may change through normal use, charging cycles, software updates or recalibration.
PremiumSalezUk does not guarantee that the percentage will remain permanently unchanged.
Nothing in this section removes rights relating to a faulty or misdescribed battery.
5. IMEI and serial-number records
PremiumSalezUk may record the IMEI, serial number and other unique identifiers of a device before dispatch.
These records may be used to:
- Confirm the identity of the phone supplied
- Process returns
- Prevent device-switching fraud
- Investigate lost or stolen shipments
- Respond to payment disputes
- Provide evidence to payment processors, banks, couriers or authorities where lawful
A returned device must match the IMEI or serial number of the device originally supplied.
6. Photographic and video records
PremiumSalezUk may photograph or record devices and parcels before dispatch.
Records may include:
- Front and rear condition
- Screen condition
- IMEI or serial information
- Device functionality
- Packaging
- Parcel labels
- Sealing of the parcel
These records may be retained for order-management, fraud-prevention and dispute-resolution purposes.
7. Prices
The customer will be told the agreed price before payment.
Any delivery costs or additional agreed charges will be disclosed before the order is completed.
PremiumSalezUk will not increase an agreed price after payment unless the customer requests and agrees to a change in the order.
8. Payment
Website orders use the payment methods shown at Shopify checkout. Separately agreed orders may use a Stripe Payment Link.
The customer confirms that they are authorised to use the payment method supplied.
PremiumSalezUk may decline, delay or cancel an order where:
- Payment fails
- Payment is reversed
- Fraud is reasonably suspected
- Delivery information cannot be verified
- The product is no longer available
If we cannot fulfil and cancel a paid order before supply, we refund payments taken for that order without undue delay. These terms do not give us an unrestricted right to cancel accepted contracts.
9. Order acceptance
An order becomes accepted when PremiumSalezUk has received payment and confirms that the order will be fulfilled.
A payment receipt alone does not necessarily mean an order has been accepted if PremiumSalezUk subsequently identifies a genuine availability, pricing or fraud issue.
10. Invoices and order records
PremiumSalezUk may issue a customer invoice containing device-specific information.
Customers should check their invoice or order confirmation promptly and contact PremiumSalezUk if anything appears incorrect.
The invoice may form part of the evidence of what was agreed and supplied.
11. Delivery
PremiumSalezUk uses Royal Mail. See our Shipping Policy and checkout for the service, charge, dispatch cut-off and delivery estimate.
The customer is responsible for providing a complete and accurate delivery address.
PremiumSalezUk may retain:
- Tracking details
- Proof of postage
- Delivery confirmations
- Signatures
- Delivery photographs where available
Unless otherwise agreed, distance-sale goods should generally be delivered within 30 days.
12. Risk during UK delivery
Where UK consumer law applies, goods generally remain at PremiumSalezUk’s risk until they come into the physical possession of the customer or a nominated person other than the carrier, subject to the independently commissioned carrier exception below.
13. Reshippers, freight forwarders and Zambian customers
Many international customers, including customers in Zambia, may choose to have their order delivered to an independent UK-based freight forwarder, reshipper or logistics provider.
Where the customer independently selects such a service and instructs PremiumSalezUk to deliver the device to that service:
- PremiumSalezUk will deliver to the UK address supplied by the customer.
- The customer is responsible for choosing and instructing the onward shipping provider.
- The onward shipping contract is generally between the customer and that provider.
- PremiumSalezUk does not control the onward shipment from the reshipper to Zambia or another destination.
Under section 29 of the Consumer Rights Act 2015, if a consumer independently commissions a carrier that the trader did not name as a delivery option, risk may pass when the goods are delivered to that carrier.
Where risk has lawfully passed, PremiumSalezUk is not responsible for subsequent:
- Loss during onward international transport
- Damage caused by the forwarding company
- Customs delays
- Import delays
- Mishandling after delivery to the nominated carrier
- Additional charges imposed by the forwarder
- Loss caused by incorrect instructions provided by the customer to the forwarder
This clause does not remove rights that cannot lawfully be excluded.
14. Proof of delivery to a nominated reshipper
Where tracking confirms delivery to the forwarding or reshipping address supplied by the customer, that evidence may be used to show that PremiumSalezUk completed the UK delivery leg.
If the parcel is subsequently lost after the nominated forwarding company receives it, responsibility will depend on the applicable law and the customer’s agreement with that forwarding company.
15. International imports
International customers are responsible for checking that the device may lawfully be imported into their destination country.
Unless expressly agreed otherwise, international customers are responsible for:
- Import duties
- Customs charges
- Local taxes
- Customs-clearance costs
- Import restrictions
- Registration requirements
- Charges imposed by the freight forwarder
PremiumSalezUk is not responsible for delays caused solely by overseas customs authorities or the customer’s chosen forwarding service.
16. UK 14-day cancellation right
Where a UK consumer buys remotely, such as through a website, payment link, email, social media or messaging service, they will generally have 14 days after delivery to tell PremiumSalezUk that they wish to cancel without giving a reason.
Customers should send cancellation requests to:
sales@premiumsalezuk.co.uk
PremiumSalezUk covers standard return postage for UK consumer cancellations where the device is returned from within the UK. Contact us to arrange a suitable prepaid return method. This does not promise free international change-of-mind returns or restrict any mandatory rights relating to faulty goods.
The cancellation period runs from the day after receipt by you or a nominated person other than the carrier. After notifying cancellation, return the goods within a further 14 days. Cancellation does not require our approval. See our Returns & Refunds Policy for the process and optional cancellation form.
17. Importance of giving cancellation information
UK distance-selling rules require traders to tell customers about their cancellation rights. Failure to provide this information can extend the cancellation period significantly.
PremiumSalezUk therefore provides these cancellation terms before or at the time of sale.
18. Cancellation form
A customer may cancel by emailing PremiumSalezUk or by sending a written notice containing:
- Name
- Order or invoice number
- Device purchased
- Date received
- Statement confirming cancellation
Email: sales@premiumsalezuk.co.uk
19. Return requirements
Before returning a phone, the customer should contact PremiumSalezUk for return instructions.
Unless otherwise agreed, the customer should:
- Return the same device supplied
- Ensure IMEI and serial numbers match
- Remove personal data
- Sign out of Apple ID, Google account or equivalent
- Disable Find My iPhone / Activation Lock or similar services
- Remove passcodes
- Return supplied accessories where applicable
- Package the device securely
20. Inspection of returned devices
PremiumSalezUk may inspect returned devices to verify:
- IMEI
- Serial number
- Physical condition
- Account-lock status
- Functionality
- Included accessories
Where legally permitted, PremiumSalezUk may account for diminished value caused by handling beyond what was reasonably necessary to inspect the goods.
21. Faulty or misdescribed goods
PremiumSalezUk will not use these Terms & Conditions to restrict lawful remedies where a phone is:
- Faulty
- Not as described
- Not fit for purpose
- Not of satisfactory quality
Businesses must offer appropriate remedies where goods are faulty or misdescribed.
22. Short-term right to reject
For UK consumer purchases, customers normally have a short-term right to reject faulty or otherwise non-conforming goods within 30 days, subject to the applicable legal rules. Rights do not automatically end after 30 days.
Additional remedies may include repair, replacement, price reduction or final rejection depending on the circumstances.
23. No additional commercial warranty
PremiumSalezUk does not currently provide a separate voluntary commercial warranty unless explicitly stated for a particular device.
This does not remove any statutory rights the customer has.
24. Customer-caused damage
PremiumSalezUk is not responsible for damage that occurs after delivery and is caused by circumstances for which PremiumSalezUk is not legally responsible, including where applicable:
- Accidental damage
- Drops or impact damage
- Liquid damage occurring after delivery
- Misuse
- Neglect
- Unauthorised modification
- Improper repair
- Damage caused by unsuitable accessories
This does not exclude liability for faults already present when the device was supplied.
25. Third-party repair attempts
If a customer or third-party repair shop opens, modifies or repairs the device after delivery, this may affect whether later damage can reasonably be attributed to PremiumSalezUk.
This does not automatically remove statutory rights relating to a fault that was already present.
26. Activation locks and accounts
Please remove account locks before return. Contact us if a fault prevents this. This request does not override statutory rights or refund deadlines.
Where a return remains activation locked, PremiumSalezUk may ask the customer to remove the account before inspection or resale can be completed.
27. Refunds
For statutory cancellation, we refund without undue delay and within 14 days of receiving the goods back or evidence of return, whichever is earlier. We include the cost of our least expensive standard outbound delivery option. Refunds use the original payment method unless you expressly agree otherwise, without a refund fee. We charge no cancellation or restocking fee. Other refunds follow applicable legal deadlines; bank processing does not extend our obligation to issue a refund on time.
28. Chargebacks and disputes
Customers are encouraged to contact PremiumSalezUk first if there is a problem with an order.
Nothing in these terms prevents customers from exercising legitimate rights through:
- Their bank
- Card issuer
- Stripe
- A court
- Any applicable consumer-protection mechanism
PremiumSalezUk may challenge disputes it reasonably believes are incorrect, fraudulent or abusive.
29. Evidence used in disputes
PremiumSalezUk may submit relevant evidence including:
- Customer invoices
- Device descriptions
- Messages
- Payment records
- IMEI records
- Serial-number records
- Device photographs
- Packing videos
- Tracking information
- Proof of delivery
- Return inspection records
- Customer correspondence
30. Fraud and device substitution
Customers must not knowingly:
- Return a different phone
- Return a device with a different IMEI
- Swap parts
- Remove components
- Submit a counterfeit return
- Intentionally damage a device to obtain a refund
- Make a knowingly false non-delivery claim
Suspected fraud may be reported to relevant payment providers, banks, delivery companies or authorities where lawful.
31. Limitation of liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
PremiumSalezUk does not seek to exclude liability for:
- Fraud
- Fraudulent misrepresentation
- Death or personal injury caused by negligence
- Statutory consumer rights
- Faulty or misdescribed goods where liability cannot legally be excluded
32. Changes to these Terms
PremiumSalezUk may update these Terms & Conditions from time to time.
The version made available when an order was placed applies to that order. Later changes do not retrospectively reduce the customer’s rights under an existing contract.
33. Governing law
These Terms & Conditions are governed by the law of England and Wales, subject to any mandatory consumer rights that may apply to a particular customer.
